General terms and conditions

Christoph Tacke Hotel- und Gaststättenbetriebs GmbH

Please note the following General Terms and Conditions (GTC) which govern the contractual relationship between you and us and shall apply in mutual interest and which you automatically acknowledge with the booking.

I. Scope of application

1.) All offers, agreements and services are exclusively based on these conditions. Deviating conditions which have not been explicitly acknowledged by the hotel are non-binding, even if these have not been explicitly contradicted.

II. Conclusion of contract, contractual partners

1.) The contract comes about through the acceptance of the guest’s request by the hotel. The hotel is free to confirm the room booking in writing.

2.) Contractual partners are the hotel and the guest. If a third party has ordered for the guest, the third party together with the guest is liable towards the hotel as joint debtors for all obligations arising from the hotel accommodation contract, if a corresponding third party declaration is available to the hotel.

3.) If no confirmation has been received by the hotel regarding the option date which is indicated in the hotel offer, the reservation is automatically cancelled.

4.) Upon conclusion of contract, the hotel is entitled to require an adequate advance payment or security deposit from the guest. The amount of advance payment and the payment dates can be agreed in the contract in writing.

III. Services, prices, payment

1.) The hotel undertakes to offer the most favourable room rate (overnight stay including breakfast buffet). Otherwise the difference from the offered price will be credited to the more favourable price. Package or arrangement prices are excluded from this provision.

2.) The hotel is obligated to keep ready the room booked by the guest and to provide the agreed services.

3.) All hotel rooms have a desk, TV with radio, telephone, a box spring bed, WLAN, hair dryer, bathtub/shower, toilet and safe. All public areas of the hotel are accessible by wheelchair.

4.) Vogelsburg gastronomy services are available from 7 am to 10 pm. Breakfast buffet is included in the price.

5.) The prices on our price lists basically apply. The respective price list with the latest date is valid. The prices mentioned in the offer only apply with written offers or confirmations.

6.) The guest is obligated to pay for the room accommodation and the prevailing or agreed hotel prices as well as additional services used. This also applies to services arranged by the guest and outlays to third parties. The agreed prices include the respective statutory value added tax.

7.) Hotel invoices without due date are payable without deduction within 10 days from receipt of the invoice. The hotel can require the immediate payment of outstanding debts by the guest at any time. In case of default in payment, the hotel is entitled to charge interest on arrears. The hotel reserves the right to provide proof that the damage it incurred was greater.

8.) The hotel is entitled, at the beginning and during the guest’s stay, to require an adequate advance payment or security deposit from the guest for existing or future claims arising from the contract if such claims have not yet been made.

IV. Withdrawal by the guest

1.) Cancellations require the hotel’s express written confirmation, but whereby no waiver of cancellation or no-show fees is associated.

2.) If the guest should withdraw from their planned stay or utilisation of the hotel’s services, the following cancellation or no-show fees based on the room rate or arrangement/package price shall apply:

For booking up to 3 rooms:

- Up until the 4th day before arrival: free of charge

- From the 3rd to the 1st day before the booked stay: 50% cancellation fee

- From the 1st day before the booked stay: 70% cancellation or no-show fee

For booking more than 3 rooms:

- Up until the 15th day before arrival: free of charge

- From the 14th to the 11th day before the booked stay: 30% cancellation fee

- From the 10th to the 6th day before the booked stay: 60% cancellation fee

- From the 5th day before the booked stay: 80% cancellation or no-show fee

When booking meals and beverages for more than 15 people:

- Feedback concerning exact number of participants by no later than 14 days before the event

- Free cancellation of booked services up to 40 days before the event

- From the 39th day to 7 days before the booked event: 20% of booked services

- From the 6th to 1st day before the booked event: 60% of booked services

- With non-appearance on the day of the booked event: 100% of booked services

We recommend that you take out travel cancellation insurance!

V. Withdrawal by the hotel

1.) If an agreed or required advance payment or security deposit is not made, the hotel is entitled to withdrawal from contract.

2.) The hotel is entitled to extraordinarily withdraw from the contract for objectively justified reason, for instance if:

- Force majeure or other circumstances beyond the hotel’s control make fulfilment of the contract impossible

- Rooms are booked under misleading or false statement regarding essential facts, e.g. concerning the identity of the guest of the purpose of their stay

- The hotel has justified reason to assume that the utilisation of the hotel service can jeopardise the smooth business operations, security or public reputation of the hotel without this being attributable to the hotel’s sphere of control or organisation.

3.) In case of justified withdrawal by the hotel, the guest has no right to compensation.

VI. Provision, transfer and return of rooms

1.) The guest does not acquire any right to the provision of specific rooms.

2.) Booked rooms are available from 3 pm on the confirmed day of arrival. The guest does not have any right to an earlier provision. If a later arrival time has not been explicitly agreed with the hotel, the hotel has the right to assign the booked room elsewhere after 7 pm, without the guest being able to derive a claim based on this.

3.) The room must be vacated by no later than 11 am on the day of departure. After that the hotel can charge half of the room lodging price due to the delayed clearance by 6 pm, and the full room lodging price after 6 pm. If the guest desires a later departure, they will be asked to coordinate this with the hotel up to 24 hours before the scheduled departure. But there is no obligation concerning the hotel’s consent.

4.) All rooms and public areas are the hotel’s property and therefore to be treated with great care. The hotel reserves the right to compensation in case of wilful damage.

5.) There is a no-smoking policy in all of the hotel’s rooms.

VII. The hotel’s liability

1.) The hotel is to act with the due diligence of a prudent merchant and is liable as such for its obligations arising from the contract. Guest claims for compensation are excluded. Exceptions to this are claims arising from the injury to life, body or health if the hotel is responsible for the breach of duty and other claims which are based on a wilful or grossly negligent breach of duty by the hotel. A breach of duty by the hotel is equivalent to a breach of duty by a legal representative or vicarious agent of the hotel. If disruptions of deficiencies in the hotel’s services arise, the hotel will endeavour to provide a remedy upon knowledge of the situation or upon immediate complaint by the guest. The guest is obligated to take reasonable steps to remedy the disruption and to minimise any possible damage.

2.) The hotel is liable to the guest for items brought into the hotel in accordance with statutory provisions.

3.) All of the rooms in the hotel have a safe. The hotel recommends making use of this.

VIII. Final provisions

1.) Place of performance and place of jurisdiction is the legal domicile of the hotel.

2.) The law of the Federal Republic of Germany applies to the legal designation of the hotel.

3.) Should individual provisions of these agreements become ineffective, the remaining provisions will not be affected in terms of their effectiveness. Apart from that, the legal provisions apply.
